CRESTAL BALL Privacy Policy

Effective Date: August 24, 2026 · Last Updated: August 24, 2026

This Privacy Policy explains how Koncierge, Inc., a Rhode Island corporation doing business as CRESTAL BALL ("CRESTAL BALL," "Company," "we," "us," or "our"), collects, uses, discloses, and protects personal information in connection with our website, platform, and related services (collectively, the "Service").

This Policy applies to two different groups of people, and it matters which one you are:

  • Customers — the real estate agents, loan officers, and other professionals who create an account, claim a Territory, and use the Service; and
  • Homeowners / Property Records Subjects — individuals whose property or homeowner information appears in Territory Data that CRESTAL BALL licenses from third-party sources and makes available to Customers. You do not need to have visited our website or created an account for your information to appear here — see Section 4.

If you have questions about which section applies to you, see Section 4 and Section 10 (Your Privacy Rights).

1. Personal Information We Collect

1.1 Information Customers provide directly

When you create an account, claim a Territory, or contact us, we collect information such as:

  • Identity and contact information: name, email address, phone number, business address, brokerage/company name;
  • Professional information: real estate or mortgage license number, license state, Profession Category;
  • Billing information: billing address and payment details (processed by our third-party payment processor — see Section 3; CRESTAL BALL does not store full payment card numbers);
  • Account content: any Customer Content you upload (notes, branding, client lists you choose to import); and
  • Communications: messages you send us through support, email, or in-Service chat.

1.2 Information collected automatically

When you use the Service, we automatically collect:

  • Device and usage data: IP address, browser type, device identifiers, pages viewed, features used, referring URLs, and timestamps;
  • Cookies and similar technologies: session cookies, analytics cookies (e.g., Google Analytics), and advertising identifiers (e.g., Meta Pixel, TikTok Pixel, Google Ads) — see Section 6; and
  • Approximate location: derived from IP address, and precise location if you enable it in your browser/device settings for a mapping feature.

1.3 Homeowner / Territory Data (third-party sourced)

To power the Service's core functionality, CRESTAL BALL licenses and compiles property and homeowner information from:

  • Licensed data aggregators (e.g., providers such as ATTOM, CoreLogic, Estated, DataTree, or similar bulk property-data licensors);
  • County assessor, recorder, and other public government records; and
  • Licensed multiple listing service (MLS) data, where CRESTAL BALL or its Customers hold applicable licenses.

This data — "Territory Data" — may include a property's address, assessed/estimated value, ownership history, mortgage and lien information reflected in public records, tax records, and, where available in our sources, an owner's name and mailing address. Territory Data is made available to Customers who have claimed the corresponding Territory, as described in our Terms of Service.

CRESTAL BALL does not collect Territory Data directly from homeowners, and homeowners are typically not aware their information is compiled in the Service. See Section 4 for what this means for your rights if you are a homeowner rather than a Customer.

2. How We Use Personal Information

We use personal information to:

  • provide, operate, and maintain the Service, including Territory claims, billing, and account management;
  • verify Customer license status and eligibility;
  • compile, maintain, and deliver Territory Data to the Customer(s) who have claimed the applicable Territory;
  • process payments and manage subscriptions;
  • communicate with Customers about the Service, including support, billing, and policy updates;
  • market the Service to prospective Customers, including through analytics and advertising described in Section 6;
  • detect, investigate, and prevent fraud, abuse, and security incidents;
  • comply with legal obligations and enforce our Terms of Service; and
  • improve and develop the Service, including aggregated or de-identified analysis.

We do not use Territory Data to make decisions about a homeowner's eligibility for credit, insurance, employment, or housing, and Territory Data is not a "consumer report" under the Fair Credit Reporting Act.

3. How We Share Personal Information

We share personal information with:

  • Other Customers: Territory Data associated with a claimed Territory is made available to the Customer(s) who hold that Territory (which may include more than one Customer in different, non-competing Profession Categories, as described in our Terms of Service);
  • Service providers: payment processors (e.g., Stripe), cloud hosting providers, customer support tools, and analytics/advertising providers described in Section 6, each acting on our behalf under contract;
  • Data licensors: the aggregators, county sources, and MLS providers described in Section 1.3, to the extent necessary to obtain and refresh Territory Data;
  • Professional license verification services, to confirm Customer eligibility;
  • Legal and safety purposes: to comply with a subpoena, court order, or other legal process, to enforce our Terms of Service, or to protect the rights, property, or safety of CRESTAL BALL, our Customers, or others; and
  • Business transfers: in connection with a merger, financing, acquisition, or sale of assets, subject to standard confidentiality protections.

We do not sell homeowner or Customer personal information to third parties for their own independent marketing purposes outside the Service. As described in Section 8, however, certain disclosures described above — specifically, providing Territory Data to paying Customers, and certain advertising-technology disclosures described in Section 6 — are treated as a "sale" or "share" under California and similar state privacy laws because of how those laws define those terms, even though we do not consider this a sale in the everyday sense of the word. Section 8 explains your rights regarding this.

4. If You Are a Homeowner (Not a Customer)

If your property or ownership information appears in the Service as Territory Data, you are not a Customer and have likely never interacted with CRESTAL BALL directly. Here is what that means:

  • Where it comes from. Your information came from the third-party sources listed in Section 1.3 — typically public government records and licensed data providers — not from you directly and not from your consent to use our Service.
  • What we do with it. We compile it into Territory Data and make it available to the real estate or mortgage professional(s) who have claimed the Territory covering your property, for their professional marketing and outreach purposes.
  • Your rights. Depending on your state of residence, you may have the right to know what information we have about you, request its deletion, request correction of inaccurate information, and opt out of "sale" or "sharing" of your information, as described in Section 8. Because we do not have a direct account relationship with homeowners, we verify these requests using the property address and other identifying information you provide — see Section 10.
  • We are not a data furnisher for credit purposes. Territory Data is not used, and may not be used by our Customers through the Service, to determine your eligibility for credit, insurance, employment, or housing.

6. Cookies, Analytics, and Advertising

We and our vendors use cookies, pixels, SDKs, and similar technologies to:

  • keep you logged in and remember preferences (essential/strictly necessary);
  • measure site usage and performance through analytics tools such as Google Analytics (analytics); and
  • measure and optimize advertising, including through pixels such as Meta Pixel, TikTok Pixel, or Google Ads conversion tracking, which may involve sharing identifiers (e.g., a hashed email or device ID) with those platforms so they can match visitors to their own users (advertising).

The advertising category described above may constitute "cross-context behavioral advertising" or a "share"/"sale" of personal information under California, Colorado, Connecticut, Virginia, Utah, and similar state privacy laws, because it involves disclosing an online identifier to a third party for cross-site advertising purposes. See Section 8 for your opt-out rights, including how we honor the Global Privacy Control (GPC) browser signal.

You can control cookies through your browser settings, and, where legally required, through a cookie-preference banner on our website. Disabling essential cookies may prevent parts of the Service from working.

7. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy:

  • Customer account data: for the duration of your account plus a reasonable period afterward for legal, tax, dispute-resolution, and backup purposes;
  • Territory Data: for as long as the applicable Territory is active or licensed source data remains current, refreshed and purged consistent with our data licensing agreements; and
  • Marketing/analytics data: consistent with the retention settings of the applicable analytics/advertising platform, generally 14–26 months unless you opt out sooner.

We may retain de-identified or aggregated data indefinitely.

8. Your Privacy Rights

8.1 California (CCPA/CPRA)

If you are a California resident — whether a Customer or a homeowner whose information appears in Territory Data — you have the right to:

  • Know/Access: request the categories and specific pieces of personal information we have collected, used, disclosed, and (where applicable) sold or shared about you, and our sources and purposes for doing so;
  • Delete: request deletion of personal information we hold about you, subject to certain exceptions (e.g., to complete a transaction, comply with a legal obligation, or exercise free speech);
  • Correct: request correction of inaccurate personal information;
  • Opt out of sale/sharing: opt out of the "sale" or "sharing" (including for cross-context behavioral advertising) of your personal information, as described in Sections 3 and 6;
  • Limit use of sensitive personal information, to the extent we process any (we do not intentionally collect Social Security numbers, precise geolocation of a person as opposed to a property, or other CCPA-defined sensitive categories beyond what is inherent in property/license records); and
  • Non-discrimination: we will not deny goods/services, charge different prices, or provide a different level of service because you exercised a privacy right, and not provide a financial incentive program at this time.

Categories of personal information we collect, by CCPA category, generally include: identifiers (name, email, address, IP address); customer records information (billing details); professional/employment-related information (license number); commercial information (subscription history); internet/network activity (usage data, cookies); geolocation data (property address, approximate device location); and inferences.

To exercise these rights, see Section 10. We will verify your request and respond within the time required by law (generally 45 days, extendable once by an additional 45 days with notice to you). You may designate an authorized agent to submit a request on your behalf.

8.2 Colorado, Connecticut, Virginia, Utah, and other comprehensive state privacy laws

If you are a resident of Colorado, Connecticut, Virginia, Utah, or another state with a comprehensive privacy law in effect, you generally have the right to access, correct, delete, and obtain a portable copy of your personal information, and to opt out of targeted advertising, the sale of personal information, and (in Colorado, Connecticut, and Virginia) profiling in furtherance of decisions with legal or similarly significant effects. Colorado and Connecticut also provide a right to appeal a denied request — see Section 10 for how to do so.

8.3 Do Not Sell or Share My Personal Information / Opt-Out Mechanism

You can opt out of the "sale"/"sharing" disclosures described in Sections 3 and 6 by:

  • using the "Do Not Sell or Share My Personal Information" link in our website footer;
  • emailing info@crestalball.com with your request; or
  • enabling the Global Privacy Control (GPC) browser signal, which we will honor as a valid opt-out request for browsing sessions where it is detected.

Opting out of "sale/sharing" does not stop Territory Data from being provided to the Customer(s) who have already claimed the Territory covering a given property as part of their existing subscription during its term, but it will stop that data from being used for the cross-context advertising purposes described in Section 6 and will be applied to future Territory Data compilation to the extent technically feasible.

9. Children's Privacy

The Service is intended for licensed professionals and is not directed to, and we do not knowingly collect personal information from, individuals under 18. If we learn we have collected personal information from a child under 18 without appropriate consent, we will delete it.

10. How to Exercise Your Rights / Contact Us

To exercise any right described in this Policy, contact us at:

Email: info@crestalball.com
Mail: Koncierge, Inc. d/b/a CRESTAL BALL, [mailing address — to be completed]

For homeowners without a CRESTAL BALL account, please include the property address and your name so we can locate and verify your information; we may ask for additional information solely to verify your identity or authority to make the request. If we deny your request, Colorado and Connecticut residents may appeal by replying to our denial email with the word "Appeal," and we will respond within 60 days, after which you may contact your state Attorney General.

11. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor security review. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

12. Third-Party Links and Services

The Service may link to or integrate with third-party services (payment processors, MLS portals, mapping providers). This Policy does not cover those third parties' privacy practices; review their own privacy policies.

13. Changes to This Policy

We may update this Policy from time to time. Material changes will be reflected by a new "Last Updated" date and, for material changes affecting Customers' rights, additional notice (e.g., email or in-Service notice) consistent with our Terms of Service.

Compliance note

This document is a working draft. Before publishing, have counsel confirm: (1) whether CRESTAL BALL's business of licensing homeowner data and making it available to paying Customers requires registration as a "data broker" under California's Delete Act and similar registration laws in Vermont, Oregon, and Texas; (2) the actual analytics/advertising vendors in use, so Section 6 lists them accurately; (3) the specific data aggregator(s), and whether their license terms impose additional required disclosures or restrict onward disclosure to Customers; and (4) whether a cookie-consent banner is required for your specific traffic mix.
